Legal Notice and Limitation of Liability of FAIN Ascensores, S.A. Regarding the Use of the Cultural Exchange Platform “dothegap”

1. Purpose

FAIN Ascensores, S.A. provides its employees with access to the dothegap platform, a digital marketplace designed to facilitate direct contact between individuals interested in organizing cultural exchanges. Access to this platform is provided solely as a voluntary benefit or additional resource for employees.

2. Nature of the Service

FAIN Ascensores, S.A. acts solely as a facilitator of access to the platform and does not participate in the organization, management, supervision, or intermediation of any cultural exchanges that may arise between users. The platform exclusively enables users to publish information and contact one another in order to arrange cultural exchanges directly.

3. Absence of Relationship with Employment Activities

Participation in any cultural exchange organized through the platform is voluntary and undertaken strictly in a personal capacity, outside the scope of the employment relationship with FAIN Ascensores, S.A.

In particular:

  • Such exchanges do not form part of the employee’s job duties;
  • They do not constitute business travel or company-related trips;
  • They are not covered by corporate travel policies, insurance, or company liability, unless expressly stated otherwise.

Participation in such exchanges does not form part of employment compensation nor of the contractual conditions of employment.

4. Agreements Between Private Parties

Any communication, negotiation, or agreement relating to:

  • Accommodation or lodging
  • Financial conditions
  • Duration of the exchange
  • Transportation or travel arrangements
  • Meals or subsistence
  • Insurance
  • Responsibilities during the stay
  • Legal or administrative requirements

shall be negotiated and agreed directly between employees and the participating families or individuals, under their sole responsibility. FAIN Ascensores, S.A. is not a party to such agreements and does not intervene in their negotiation or execution.

5. Verification of Information and Due Diligence

FAIN Ascensores, S.A. does not verify or guarantee:

  • The truthfulness or accuracy of the information published
  • The suitability of the families or accommodations
  • The quality, safety, or conditions of the cultural exchanges

Employees who choose to participate in exchanges must conduct their own checks, evaluations, and agreements as they deem appropriate before taking part in any exchange.

6. Participation of Minors

Where cultural exchanges involve the participation or stay of minors, the employees and participating families shall be solely responsible for ensuring compliance with all applicable regulations relating to:

  • Protection of minors
  • Parental or legal authorizations
  • Required documentation
  • Adequate insurance coverage
  • Conditions of stay and supervision

FAIN Ascensores, S.A. does not conduct verification of the individuals, families, or accommodations involved in the exchanges and assumes no responsibility whatsoever for the care, supervision, or well-being of any minors who may participate.

7. Regulatory Compliance and Insurance

Participating employees shall be responsible for complying with all applicable laws and regulations related to cultural exchanges, including, where applicable:

  • Immigration or visa requirements
  • International travel regulations
  • Procurement of personal or travel insurance
  • Any necessary legal authorizations

FAIN Ascensores, S.A. does not provide or guarantee insurance coverage for activities arising from such exchanges.

8. Limitation of Liability

Employees who use the dothegap platform acknowledge that they do so voluntarily and at their own sole risk.

To the fullest extent permitted by applicable law, FAIN Ascensores, S.A. shall not be liable for any damage, loss, incident, or claim that may arise directly or indirectly from:

  • The use of the platform
  • Agreements reached between users
  • The execution or development of cultural exchanges
  • Any conduct, action, or omission by participants

9. Acceptance of the Notice

Access to and use of the platform implies that employees of FAIN Ascensores, S.A. have read, understood, and accepted this notice.

10. End of the Benefit

Upon the end of the employment relationship between the employee and FAIN Ascensores, S.A., the user will no longer have access to the platform.
